1. Who is responsible and what this notice covers

This notice covers the Fonzy.ai marketing website and enquiries submitted through its contact form or sent to us by email. It does not describe data processing inside the separate Fonzy application or customer accounts.

2. Information we process

When you use the contact form, we process your first name, optional last name, email address and message. Your first name, email address and message are required so we can handle your enquiry. Without them, the form cannot accept your enquiry. Please include only information needed for your request.

We also record an enquiry identifier, timestamps and notification status, together with technical records used to recognise retries and track notification attempts. The notification record contains a copy of your enquiry and may include an email provider reference or error status.

When you visit the website, Cloudflare processes technical request information, such as your IP address and request details, to deliver and protect the website. The contact endpoint uses your IP address for rate limiting and abuse prevention.

3. Why we use this information

We use enquiry information to receive, review and respond to your request and carry out related follow-up. For general enquiries, our legal basis is our legitimate interest in handling business correspondence. Where your request concerns entering into a contract with us, we process the information needed to take steps at your request before that contract.

We process technical information for our legitimate interest in operating a reliable website and preventing spam, abuse and security incidents. We may also retain or disclose information where required to meet applicable legal obligations.

Submitting the contact form does not automatically subscribe you to marketing emails.

4. Storage, notifications and service providers

Cloudflare hosts the website. Accepted contact enquiries are saved in a Cloudflare D1 database configured with EU jurisdiction before an email notification is attempted. A saved enquiry remains stored if that notification fails; confirmation that an enquiry was saved does not mean an email was delivered.

Resend processes the enquiry details to send a notification to hello@fonzy.ai. The enquiry may therefore also be held in the mailbox used to handle and follow up on your request. Access is limited to people and service providers who need the information to handle enquiries or operate and protect the website.

The database's EU jurisdiction does not mean that every provider operation takes place in the EU. Resend states that its primary processing operations take place in the United States. Its published data-processing terms provide for international transfer safeguards, including Standard Contractual Clauses. You can contact us for information about the safeguards relevant to your enquiry.

5. How long we keep information

We retain enquiry information and related correspondence only for as long as needed to handle the enquiry, carry out relevant follow-up and meet applicable legal obligations. The appropriate period depends on the subject of the enquiry, whether follow-up is ongoing and any legal requirements that apply. Technical and security information is retained as needed for website operation and protection.

6. Your rights

Depending on the circumstances and applicable data-protection law, you may request access to your personal data, correction, deletion, restriction of processing or a portable copy. You may object to processing based on legitimate interests. Contact hello@fonzy.ai to exercise your rights; we may ask for information needed to verify your identity and handle the request.

You can also lodge a complaint with the Belgian Data Protection Authority or the data-protection supervisory authority in your country.

Links to other websites are governed by those websites' own privacy notices. This notice does not cover how they process your information.
